Abstract
The Non-contentious Procedure Act (hereinafter: ZNP) has been adopted in 1996, that is before the independence of the Republic of Slovenia, changes in the legal system and ratification of the European Convention for the Protection of the Human Rights and Fundamental Liberties. Due to such changes in the legal system of Republic of Slovenia it is necessary to re-evaluate the compatibility of the current non-contentious proceeding organization in Republic of Slovenia with the constitutional system and provisions of the International Law. It is also necessary to assess the compatibility of certain ZNP''s provision with the new Slovenian legislation. The analysis of access to the justice, relationship between the principle of free disposal and »sua sponte« and relationship between the protection of parties rights and public interest is also important. The following object of research shall also be the »sua sponte« proceeding in the non-contentious proceeding, Land Register proceeding, proceeding in the settlement of several relationships from the Company Law and Family Law relationships in non-contentious proceeding.
