Simplification of the enforcement in the EU

The monograph represents complex work, in wich european enforcement order is analysed in the system of european civil law and its implementation in the practice in Slovenia, Austria and Germany. Editorship and co-authoship of the monograph published by internationally recognized publisher Nomos is an outstanding scientific achievement and an example of cross-border cooperation, which provides internationally comparable results of scientific research.

Companies Act

Legislative dynamics in the field of commercial law has required new monographic treatment of new regulation of this important area of ​​law. Prof. Dr. Marijan Kocbek and prof. Dr. Saša Prelič, authors of previous explanations of the Amendements to Companies Act, as a leading experts in the field of corporate law, prepared explainations to this last amendments of Companies Act with an ambition to comprehensively present all the most important new legislative solutions.

Does ZJN-2 provides for mandatory direct payments to subcontractors

The article deals with issues of direct payments to subcontractors. According to the Code of obligations (OZ) direct payments of the mandator to the subcontractors are foreseen only for contracts for services and construction contracts. Due to improvement of financial discipline in cases where public sector is involved The Public Procurement Act (ZJN-2) has implemented new obligations for mandators and bidders to protect subcontractors. However, the authoress argues that for direct payment within public procurement contracts, conditions regulated in the Code of Obligation must be fulfilled.

Efficiency versus fairness in civil procedure in Slovenia

In the pursuit of justice, truth always plays a prominent role. Few, if any, legal systems are willing to waive the right to claim that the results of their legal processes are fair, just, and, above all, based on the truth. In most legal systems, rules on the taking of evidence try to guarantee that an accurate factual basis is used for the application of the law. Such rules are the core of most methods of adjudication and they are the main theme of this book, which focuses specifically on the rules of evidence within the context of efficiency in civil proceedings.

The Interface European Union Energy, Environmental and Competition Law

The FIDE Congress addresses three main topics, and for each topic a general rapporteur is selected by the host FIDE member organisation. The general rapporteur drafts a questionnaire, which the rapporteurs from the EU institutions and FIDE member organisations are to respond to based on their perspective. Each general rapporteur compiles a general report based on all the reports received, which is discussed over two days in the FIDE Congress working groups moderated by leading experts in the field. The summaries of these discussions are presented at a plenary session on the closing day of the Congress.
